1. Agreement
Welcome to Done by Default. By using our website or engaging our services, you agree to these terms. Please read them carefully. If you do not agree, do not use the site or our services.
2. Services
Done by Default provides website design, development, and business automation services. The specific scope, deliverables, and timeline for any project will be outlined in a separate agreement or proposal before work begins.
3. Client Responsibilities
When you engage our services, you agree to:
- Provide accurate and complete information necessary for your project
- Respond to requests for feedback or approval in a timely manner
- Ensure you have the rights to any content (text, images, logos) you provide
- Pay invoices according to the agreed-upon schedule
4. Payment Terms
Payment terms will be specified in your project proposal. Generally:
- A deposit is required before work begins
- Final payment is due upon project completion
- Monthly hosting fees are billed in advance
- Late payments may result in service suspension
5. Intellectual Property
Your Content: You retain ownership of all content you provide (text, images, logos, etc.).
Our Work: Upon full payment, you receive ownership of the custom website and automation work we create for you. We retain the right to showcase the work in our portfolio unless otherwise agreed.
Third-Party Tools: Some projects may use third-party tools or platforms (for example, hosting services or automation platforms) which are subject to their own terms.
6. Revisions and Changes
Each project includes a specified number of revision rounds. Additional revisions or changes to the project scope may incur additional fees, which will be communicated before any extra work begins.
7. Project Timeline
We provide estimated timelines for all projects. These estimates assume timely feedback and content from you. Delays in providing materials or feedback may extend the project timeline.
8. Warranties and Disclaimers
We take pride in our work and stand behind it. However:
- We cannot guarantee specific business results (traffic, sales, rankings)
- Websites and automations are provided "as is" after the revision period
- We are not liable for issues caused by third-party services or your modifications
9. Limitation of Liability
Our liability is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate a project with written notice. If you terminate:
- Payment is due for all work completed
- Deposits are non-refundable
- You receive all completed work upon payment
11. Hosting Services
If you use our hosting services:
- We maintain backups but recommend you keep your own copies
- We reserve the right to suspend service for non-payment or policy violations
- You may cancel with 30 days notice
12. Confidentiality
We treat your business information as confidential. We will not share your data with third parties except as necessary to provide our services or as required by law.
13. Changes to Terms
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the State of Texas, United States.
